Penalty shootout for the courtroom

In the case of a hung jury, why not let the assembled legal team bring their best "shots" at appeal?

A hung jury often means a re-trial, which is commenced by a lengthy agonising, administrative and burdensome appeals process.

But at the end of a long trial, we already have the legal team assembled "on the field", as it were.

In addition, there may be lines of legal avenue or evidence that were not presented so as not to confuse the jury with multiple "plays".

I propose a brief penalty shootout with just the judge and lawyers, in camera.

A rapid-fire of legal arguments are set out. The opposing team are allowed to briefly react to each argument, but not move to strike.

If the judge feels a number of arguments have "hit the mark", an appeal case can be commenced without the months of paperwork through the appeals court.
